BG Arts Library of Things Borrower's Agreement & Items Use Policy

1. Members must be age 18 or over to borrow items from BG Arts Library of things and must only borrow items from the BG Arts Library of Things for use by themselves and not a further third party.

2. Prior to borrowing items, all Members must create an online account which provides an active email address of that Member.

3. BG Arts Library of Things staff and volunteers are available to assist in explaining operation of items. However, by taking possession of any item, the Member is certifying that they are willing and able to use that item in a safe and proper manner.

4. Only the Member is authorised to use items borrowed from BG Arts Library of Things. The Member shall not permit the use of items checked out to the Member by any other person(s) unless by the express written permission of the BG Arts Library of Things.

5. Members may be charged for borrowing an item.  During the trial period there will be no charge for borrowing items. However, there will be a donations box in the library for those who wish to make a financial contribution.

6. There is no charge for individual membership.

7. All items borrowed are to be returned to BG Arts Library of Things by close of business on their return date. Items are not to be left on the doorstep or the exterior of the premises.

8. Failure to return borrowed items in accordance within the loan period will result in the Council taking steps to recover the borrowed items from the Member.

9. Members may renew each item if (a) the Member contacts BG Arts Library of Things by noon on the day before the return date, and (b) no other Member has reserved the item.

10. BG Arts Library of Things reserves the right to refuse or limit renewals.

11. BG Arts Library of Things will only be liable to you for loss or damage caused by our negligence in failing to tell you about a known fault. We will not be liable for faults of which we are not aware of. Other than this BG Arts Library of Things exclude all liability for death or personal injury caused by our negligence and /or breach of contract. Because we are not a business, the risk to you is greater than if you were paying to hire something or buy it.

12. The Member agrees that BG Arts library of things is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed items. Each time a Member takes an item out they must check it visually before it is taken, and make other checks for any faults that may be identified before use. The Member agrees that if any borrowed item becomes unsafe or in a state of disrepair, the Member must immediately discontinue use of the item and notify BG Arts library of things.

13. If the Member is borrowing electrical equipment, the Member must check the visible wires and plug for any damage before use. Electrical items must be plugged into the RCD adaptor provided by BG Arts Library of Things at all times.

14. All items are to be returned in the same condition as they were issued, barring normal wear and tear. All items must be returned clean. BG Arts Library of Things and the Member will come to an individual agreement in respect of any loss of or damage to any item and the Member further agrees to accept the BG Arts Library of Things assessment of condition of items and on return engage in discussion of fair restitution for damage, dirtiness, delinquency, and/or loss of items. BG Arts Library of Things reserves the right to refuse the loan of any item at its discretion and/or terminate the membership of a Member should items be returned in an unsatisfactory condition.

15. If BG Arts Library of Things is not the owner of the item and only facilitates contact between you and the Owner, BG Arts Library of Things accepts no liability for the condition of any item or any loss or damage resulting from your use of it.

16. Members will not borrow the items to do professional work where fees are charged. BG Arts Library of Things public liability insurance will not extend to this activity, and the member will risk their membership being terminated.

17. The borrowed equipment is for use only by the member who has signed this agreement. It must not be used by any friends, family or other individuals who have not agreed to the borrowing terms and conditions as set out in this agreement. 

18. In the event you are hosting an event using an item borrowed from BG Arts Library of Things, you will need to obtain your own appropriate public liability insurance for that event.

19. You affirm that the information that you have provided when signing up to the online borrowing platform is current, true, and correct to the best of your knowledge and belief. You understand that this information may be subject to verification. 

20. You further state that you have read and fully understand the rules and regulations of BG Arts Library of Things, and you understand that failure to comply with any of these rules may result in revocation of your borrowing privileges and/or legal action against you. You have read the Waiver and Indemnification form below, relinquishing all claims against BG Arts Library of Things.

Liability Waiver 

The items in our library are for the use of BG Arts Library of Things members. Out of respect for future users, please take care of the items you borrow and report any damage to BG Arts Library of Things immediately. Though borrowers are responsible for damage that they have caused, we promise not to be angry. 

Members explicit agreement to the following statements - READ THIS CAREFULLY EVERY TIME YOU BORROW ANYTHING

I am willing, able and experienced in using the items I am borrowing, and that I will use the items I am borrowing in a proper manner. I am aware that BG Arts Library of Things, its partners, directors, officers, members, and employees claim no expertise and make no representation concerning the fitness of any item for any particular use.

I, do hereby waive any and all claims against BG Arts Library of Things, its officers, agents, and employees for any injury or injuries of any nature that I may suffer or incur in the use of the item that I am borrowing from BG Arts Library of Things except those caused by a defect known to BG Arts Library of Things and not made known to me.

I agree to release and indemnify and hold harmless BG Arts Library of Things, its officers, agents, and employees from any and all liability, loss, claims, and demands, actions, or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of items I am borrowing from BG Arts Library of Things.

I have read and fully understand the rules and regulations of BG Arts Library of Things and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.
